IPC 498A (a.k.a. Dowry Act) enacted by INDIAn parliament is nothing but
a state sponsored terrorism against men of the world (and their friends
and relatives living in India) using their internal social issues.
Why it is a state sponsored terrorism by INDIA -
As per IPC 498A -
1. Women can file a complaint without any evidence and her complaint is
treated as evidence
2. All accused are guilty as alleged by an Indian woman - It is a
criminal offense
3. Accused have to prove their innocence including false accusations of
mental cruelty
4. Police can not refuse to accept a complaint filed by a Indian woman
and they have to register a complaint against all the accused (Indian
women have named octogenarians and toddlers as perpetrating mental
cruelty to them - I wonder what happened to all those brilliant Indian
shrinks or Indian mental asylums to treat these Indian women)
5. Police have to arrest all the accused - irrespective of the logic or
evidence behind the complaint or irrespective of all evidence contrary
to the complaint filed by Indian woman
6. It is non bailable until the case is resolved
7. I have never seen Indian courts punish a Indian woman for filing
wrongful complaints including perjury (it is a pathetic system to say
the least), and there is no compensation of any kind - not in this life
as per Indian courts and Indian state - for financial damages, pain and
suffering.
Now let us talk about Indian Judiciary -
1. If you are visiting India, your passport will be impounded, and in
rare cases they will give you the passport after asking you to pay
exorbitant amounts (could be more than $50,000 - $100,000 and there are
cases of asking more than $500,000) in the name of 'hapless' Indian
woman victim! The beneficiary of those amounts is that hapless Indian
Woman!
2. It is one of the MOST corrupt machinery (the denizens of that place
call it - INDIA) that you can ever find on the face of the earth - it
goes from court personnel, public prosecutors, lawyers who formed
rackets to file false 498A cases solely to make money, corrupt judges,
women's organizations who want to get a portion of the loot, etc.
3. Do not expect logic (reasoning based on fairness, facts, even their
own laws, etc.) to work with judges, police, etc.
Now let us talk about Indian Police -
1. They are also one of the key perpetrators of this terrorism. They
literally will beat you up without charges or reasoning, will and can
put you in custody for weeks without ever giving you water or food, and
can even 'kill you' under any pretext if you question them why they are
doing what they are doing !!!
2. They will definitely insult you and your parents/relatives/friends,
even a language lunatic on profanity cannot match the incessant
profanity of INDIAN police.
3. They are the ones who threaten with dire consequences unless you
grease their palms with loads of cash and continue to do so as long as
the 498A case drags in the court.
Everyone - your lawyers, public prosecutors, judges, police, women's
organizations, politicians, will be interested in extracting as much
cash as they can by truly prolonging the case. What is the average
period for such a case to be dismissed - after you have spent cash
worth earnings (not savings) of multiple generations on all the things
that surround 498A and have paid to the 'victim' an insanely
astronomical amount - "8 - 10 years".
It is a racket perpetrated by INDIA.
What works is - money, money, money and more money.
They are just after your money - current savings, savings from your
forefathers and friends, and all of your future earnings (as you will
be bankrupt for the rest of your life repaying all those loans).
Ways to stop this Indian state sponsored terrorism -
1. Do not go near any Indian Woman.
You do not have to be married to get into this nightmare. Indian
woman can claim you have promised to get married her and you are in
big trouble.
One of the Judges of Indian court system has ruled that (so there
is a precedent for any male to get into trouble without ever getting
married to a Indian woman) it could be treated as if you are married to
a female to put in a 498A nightmare if a Indian woman claims so!!!
What a fair Judge of INDIA!!! There are plenty of such judges
(remember INDIA is expert on human production and not in fair laws and
judgments) if you look at their judgments and reasoning (even Indian
supreme court has woefully ridiculous and unfair rulings and continue
to have those).
Remember Indian woman are excluded from perjury, penalizations for
wrongful claims, etc. HOLY COW - that is what they are!!!
2. Do not employ any Indian men as you could be putting your company in
jeopardy especially on a critical project.
These men will focus all their energies in getting rid of the
cruelty meted out to their friends/relatives by 498A.
Remember Indian woman can name any one in her complaint - including
friends and relatives either living in India or outside India. People
who are earning higher than the INDIAN national per capita income (i.e.
$530 in Yr 2003) are potential targets for this state sponsored
terrorism.
3. Do not have any investments in INDIA.
Again, you are playing with fire when it comes to the fairness of
INDIA as a whole. Do not cry later after your house is burned by INDIA
(through 498A and other such stupid acts and institutions) and their
holy women. Consider you are fore warned.
4. Do not visit India in your life.
Remember you do not have to be Indian or married to a Indian
woman to get arrested, imprisoned, tortured, subject your friends and
relatives to both direct (through courts) and indirect (police,
lawyers, etc.) extortion.
5. Do not fall for any Indian baits - such as - we treat guests as Gods
(Athidi devo bavaha - in Sanskrit).
They lock their gods in temples as they embellish their idols with
gold and jewelry. India knows their people well enough to lock the
idols up. You will be their next demi god to be locked up (and
tortured) until you let go off all your wealth. As per Indian
philosophy and INDIAN government/state/judiciary/legislature you are a
liberated soul if they can separate you from all your worldly
possessions. They definitely want all of them from you, have no doubt
about it in a million years.
INDIA is a thief.
6. If you do not like 'enslavement' (I do not like it either) then you
should avoid INDIA altogether as INDIAn state sponsors enslavement. So
avoid INDIA.
You thought INDIA lets you off so easily. In making sure INDIA is
really getting your pound of flesh for the rest of your natural life,
the extortion through 498A is so high, that you will be working all
your life just to pay off the debts you would accumulate during your
498A case. That is why it is a state sponsored enslavement.
7. INDIA uses its 'sham democracy and women' to get money.
INDIA uses women to demand money (to feed its police, judges,
lawyers, women's organizations, women, politicians) from hard working
AND honest people who unknowingly fall for the 498A trap enacted by
INDIA. INDIA or its women never have the courage or character to repay
these victims of 498A.
What do you call those people who use women to make money? I cannot
spell it here but you know what it is called - INDIA is exactly that.
What do you call those who terrorize all men (around the world
whenever they can lay their hands on them through 498A) but sanctify
their actions (as democracy in in-action) through ignorant / nonchalant
voters? - answer is INDIA.
I like a democracy where basic rights are given to all humans such
as equality - irrespective of sex, age, religion, handicap, disease,
race; due process to all, fairness and equality to all, punish only
after establishment of guilt and not before, integrity of police,
checks and balances for legislature, checks and balances for judiciary,
etc.
INDIA has none of the above. Some one tells you otherwise they are
either lying through their teeth or they think you are an idiot to fall
victim to their charades.
Watch out for the truth - that matters most in daily life - about real
INDIA based on true stories in up coming articles.

498A Section should not be a nightmare. The reason it is so is because as we read here, the police arrest the husband and the family upon the lady's first complain and then the case starts. The lady in question can complain to the police and then the police have to tell her to hire a lawyer to fight the case. The idea seems that the lady likes to harrase the husband and his family and this can be done so easily as she does not have to lift a stick or hire a gunda as the police do that job for her and so the police are guilty here and they should firstly be taken to the court and then the husband. Come on police we have to see you as god figure. Please dont lose your chance to get moksha doing your duty. As clearly it is the police harrasing and not the husband in many cases. So is there a 498A/Police to go legally against the police? These cases will almost get very small in number if this police illegal decision is put to check. Come on police we have to see you as god figure. People are clearly not scared of a letter from the lady's lawyer as they have the time and the money to fight back with the proof we see here. But how they do this and specially from abroad as they have the fear of being arrested in the first place? If one tries to be a Gandhi in 2006 India, he/she gets a bullet bit too quick and seems from the law itself. Wah!!! UK Guy

NRI lost interest and respect for the place when recently got into this trap. Previously was visiting India regularly and also contrubuted at places of need. Totally innocent but now even scared to place information here with name and address.....simply because you never know what can happen. My life is valued by me and dont want it ruined by some thugs when such law exists in India. Can we please have more Gandhis from the politicians of India? Gandhi opened this employment.....that is Official Indian Politics. So let us give something in return to HIM please. UK Guy.

of 498A, I have a suggestion for NRI. Go to India for a holiday. Like now, don’t get involved with politics and business there in India. By now after many years abroad, you have got this title of being a NRI. Most likely you are born abroad. So be a NRI. They used to say when you marry a lady, the 2 families also get married. The problems get sorted out by the 2 families. But remember now…..REMEMBER…..NRI guy not only marries an Indian lady from India but also marries the India police, who are the first ones to arrest you before you are found guilty. Why we blame the law? The law is there. The people who put the law in place are the ones to take the responsibility. So why marry a lady from India in the first place? There are plenty of Indian ladies abroad also where you now live. The Indian lady from India will find it difficult to adjust to the life abroad…..in particular UK and then will blame you and they have the additional police force in India who they can rely on to lock you up next time you are in India or can call you to India by arresting your family member in India, if you have any there. Why marry one and try to see if she adjusts to the life in UK. Why take this risk as she has the Indian police on her side to even ruin your future visits to India. Be safe where you belong and serve that country. You are a NRI and be a NRI. Yes, visit India, see the place, enjoy the Darshans at religious places, enjoy the food and get out after that, back to where you belong. Sorry India this is happening now after personal experience. I am giving my points only about this one problem in India. It is up to others and India herself to address other issues. UK guy.

Reading all this about the misuse of law and in particular misuse of 498A, I have a suggestion for NRI. Go to India for a holiday. Like now, don’t get involved with politics and business there in India. By now after many years abroad, you have got this title of being a NRI. Most likely you are born abroad. So be a NRI. I being a 21st Century Girl doesn’t believe that India is a male dominated country because now-a-days abla’s are sabla’s I mean to say that today’s generation women always want to get something which is new branded and which also has a status symbol that too sitting at home without earning anything. This whole pressure comes on the poor husband who has to listen to his parents, to his in-law, to his boss to his children’s demand too. Irrespective of his demand he has to fulfill his family demand first.
If demand is not fulfilled by him then he has to listen to his wife’s taunts, his children’s frustration to face other problems too. Husbands also have only one person to whom they can talk i.e. to their wife, But dominating nature of wives make them more angry and violent due to which male remove their frustration in form of anger and violence. After that, the spouse or man’s better half do the propaganda of their so called plight without thinking about their husband’s mental status. Thus, adding fuel to fire. They do this with their sure shot and powerful weapon i.e. Tears. Some wives are so great that they directly go to the cops without thinking once about the consequences on their husbands and his family members, Due to which males like (Ram) have to suffer a lot.
This thought of mine can be explained with my personally witnessed experience some days back in my friend’s case. She was genuinely eve teased by some notorious guys in her neighborhood. Her father came to know about this incidence and he called the cops. The guys were taken to question by the police. But to my surprise the police did not even question us at all!!! They took us on face value and the guys were bashed royally by police. And we were not even questioned at all. I could sense the loop hole that I hear many elder married guys stuck in divorce who talks about it, like the one in my neighborhood. Before which I had no whiff about the whole thing.
I asked the police if we could leave and he understood my gesture on face. And he said to us that “You are like our daughters and we have now to be extra cautious about our image too, especially after the rape cases”
And that is where after the NC was lodged I could make out that men are really really vulnerable and women is actually dominating men using men (police) and law to the maximum of their advantage.
No doubt my friends’ grievance was genuine but the statement of the police and the treatment given to the accused at the face value of the whole matter made my conscience prick me to the extent of telling me that thank god I do not have a brother else he could have been victimized and would have been equally vulnerable to this attitude of the police.

And that is where after the NC was lodged I could make out that men are really really vulnerable and women is actually dominating men using men (police) and law to the maximum of their advantage.
No doubt my friends’ grievance was genuine but the statement of the police and the treatment given to the accused at the face value of the whole matter made my conscience prick me to the extent of telling me that thank god I do not have a brother else he could have been victimized and would have been equally vulnerable to this attitude of the police.

India is so divided as it is and such laws will only send females to some sector of the men population....eg men police, men lawyers, men judges. As per the law, men are not trusted it seems and most of the people handling the cases are men. This is the place where the same ladies will say yes sir and can end up doing whatever is said to them and will have to keep the mouth shut also, and later realise what real trouble can be.

I think Shilpa said something in the line of... he is from overseas and different culture and needs to be treated well specially when he is doing so much for India. May be an Indian guy who if had done the same to Shilpa might have faced the Indian penal code 498A or the DV law introduced by an Indian lady law maker??? For those who dont know what this penal code misuse is can check the internet for it. The overseas guys stuck in this misuse of the law by Indian ladies will know better. I think Shilpa said something in the line of... he is from overseas and different culture and needs to be treated well specially when he is doing so much for India. May be an Indian guy who if had done the same to Shilpa might have faced the Indian penal code 498A or the DV law introduced by an Indian lady law maker!!!??? Nothing is likely to happen to Gere. I have been fair in my comments regarding Indian Penal Code 498A and DV Law. Dowry demands and other harassments associated with the birth of a female and not a male are all wrong.
The argument is about the way the husband, in-laws and any other people the lady names are arrested and locked up without any evidence. Yes.....locked up.....eat and sleep inside and the hell with their families and loved ones (including children) who wait for them at home. As if they have murdered someone!!! That is harassment.
People need to be aware of the Penal Code 498A and what it can do. This lady, Pooja Chauhan from Rajkot and who went nearly naked and walked the streets to have the voice heard has made people to read about the Penal Code 498A and what it exactly means for the husbands and the in-laws. Some people and may be the women's group encouraged her to go half naked like this. The method has been wrong. I do feel sorry for the lady. Because this Penal Code 498A is available to be misused, she went as far as this. So the people who signed and agreed to this law to be in place are guilty to start with.
It shocks and saddens you to see a young woman like Pooja Chauhan take off her clothes and parade through the streets of Rajkot, Gujarat, India.
Whether she is right or wrong, alcoholic or drug addict or is after some money after harassing the husband and in-laws etc is up to the law to find out. She certainly has brought a lot of damage to the husband's side. This case will probably take very long to finalise as it seems that the arrests have been made and it is regarded as a criminal case against the husband and the in-laws. A mere sorry from Pooja will not do as now the whole matter will have to be cleared via the courts.

Misuse of the law by ladies will not help other ladies. At times one of the persons arrested in the in-law's group is a mother.....mother-in-law.....yes a lady. So much has been said about the misuse of this so called Penal Code 498A and DV law. Ladies have been unnecessarily fully armed to start with.
So basically they have been told..."go get married and then if you don’t want to live with him then you can get him and in-laws arrested and he pays quicker when behind bars." It is as simple as this.

ON 26TH JULY Peace - UK said above " Quickly Mrs Renuka Chaudhary should get involved personally in this case otherwise this case can disappear. Normally these type of criminal cases (as they are criminal case in India) take about 5-6 years to come to an end."

Where money buys the legal system, these sort of things will keep happening. The other day a guy was telling me that to survive in India, you need to be a gunda or have lots of money. And that is not the majority in India. The straight forward people and the poor form the majority and they suffer. And many of the others seem to be in power and they rule. In pakistan they overthrow such government.....and that is also not the answer. But one such overthrow in Indai will open up some people's brains and I am sorry to say that finally. Peace - UK

"There are many number of cases where even if no dowry was taken / demanded; just because wife was not able to adjust to husband home, in the name of Dowry, 498a has been used as an instrument to harass innocent husband, his age old parents and his married / unmarried sisters.
Based on girl’s complaint, police blindly without any proof or enquiry; arrested all those named in the complaint and put them in jail.
Although Judges strongly feel that provisions of 498a needs to be changed, but are unable to do any thing since power to amend Law is in the hands of our Politicians.
Since provisions of Sec, 498a IPC are one sided, this has contributed to increased divorce rate. Recently introduced Domestic Violence Act is also one sided and will further accelerate divorce rate. Single-parent system is worst for any society especially for growing children and will deteriorates Law and order situation.
India is not the only country where family disputes take place; however, no country has laws, which empowers its police to arrest family members without an investigation. In no country people are put in jails, until case has been heard by a judge and person declared a culprit. It is only in India where people implicated with 498a, are put in Jails even before case is heard by a Judge."
NRI’s are also trapped by such laws. Many previously used to visit India on regular basis and also contribute at various places but now are no longer able to do this. This Penal code 498A and DV law have been brought in too quickly to slow down any problems men might give to women. Basically it is like a dog chain on a man’s neck after he gets married.
As we hear all the time, there is a caste system existing in India and there are people who are underpaid. So as such, these people must be suffering. And as I understand, these people are in thousands. So if a law similar to Indian Penal Code 498A is introduced for these people to use (or shall I say misuse?), then what will happen to the Indian economy. Can a low caste person and can an underpaid person walk into any police station and complain and get the employer etc arrested? Surely India can collapse for a while in such circumstances as the number of people suffering seems to be very high. What if there is an uprising from this majority? The whole world will be in support of these sufferers. Why the politicians are waiting for such a time to come?
By no means I am trying to say that such one sided Penal Code 498A type laws are a useful tool. Much thought is needed for the wording of such laws. We are talking about 2007.
In real terms there are points which go against ladies. Firstly having people arrest after false complaints and then demand for money after false complaints can all be tackled as there are rules and regulations for all that. It appears that some lawyers find a quick way by encouraging men to give money to ladies to finish the cases. For arranging this, a lawyer can also get a fair share from the men. This cant be right.

New Delhi, Jan 15: Molesters beware, the government is considering to make the laws dealing with the social malaise stricter.
Women and Child Development Minister Renuka Chowdhary on Tuesday said her ministry was examining the issue and government may come up with stricter laws and implementation mechanism to deal with cases of molestation.
The minister held a two-hour long meeting with her officials here to discuss the Immoral Trafficking Act, misuse of Section 498-A of the IPC relating to dowry, laws dealing with molestation and fraudulent NRI marriages.
"We are examining the laws and the sole aim of the ministry is to ensure implementation of these laws. The problem is with implementation.
We want to ensure faster and hassle-free implementation of laws meant to serve women," Chowdhury told reporters.
"In case of Mumbai molestation, I just would like to say that politicisation of the episode is uncalled for. Therefore I don't want to say anything on the issue. It would be better if people show little sensitivity while referring to it," she said.
On whether the ministry has asked for a report on the incident, she said, "Yes we have asked for a detailed report in the case from Mumbai Police because I want to know the whole truth."
She said the ministry was also examining other laws concerning women, including those relating to fraudulent marriages.
"We are examining the whole gamut of law, keeping the interest and safety of women in mind. There are tricky situations, like a girl marries an NRI groom and later gets to know that he is already married," she said."
